O R D E R
% 14.09.2018 Petitioner is a commission agent of coal supply. Complainant used to purchase coal from the petitioner. There were financial dealings between the petitioner and owner of the vehicle, namely, Tony. Petitioner himself went to the police station and handed over the vehicle to the Investigating Officer. Complainant, who is driver of Tony, has given an affidavit before the trial court that the FIR was lodged due to some misunderstanding. It is submitted that petitioner is in custody for the last 11⁄2 month. Learned APP submits that petitioner had brought the aforesaid car to the police station after Investigating Officer made a telephone call to him.
Petitioner had not himself come to the police station to handover the Bolero Pickup car.
However, it has been admitted by the Investigating Officer present in Court that petitioner and owner of Bolero Pickup car are engaged in coal business.
Keeping in mind the totality of the facts and circumstances of this case, petitioner is admitted to bail, subject to his furnishing a personal bond in the sum of `25,000/- (Rupees Twenty Five Thousand Only) with one surety in the like amount to the satisfaction of the trial court. Bail application is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
