% 08.11.2016 This matter was heard for some time and learned Additional Solicitor General had sought time to obtain instructions. When matter is called on second occasion, learned Additional Solicitor General appearing for the petitioner states that the order dated 23.12.2013 would be implemented in the case of the respondents on or before 15.12.2016. He submits that in view of the statement made, the contempt petition pending before the tribunal may be adjourned beyond 15.12.2016 and the requirement of personal appearance of the officers of the petitioner may be dispensed with.
Learned Additional Solicitor General further states that this statement
is being made in the peculiar facts of the present case for the reason that there is delay and laches in challenging the order dated 23.12.2013. He pleads that Court may record and clarify that the question of law has not been examined and is left open, as the petitioner apprehends that similar petitions may be filed by others.
Learned counsel appearing on behalf of respondent states that he has no objection in case the decision is implemented by 15.12.2016 and the contempt petition is adjourned to a date after 15.12.2016. He states that personal presence of the officers is not required and necessary, in view of the statement made.
We take the statements made by the learned Additional Solicitor General and the counsel for the respondent on record and disposed of the present writ petition. It is clarified that we have not expressed any opinion on the question of law and legal issues. They are left open. Dasti under the signature of the Court Master. SANJIV KHANNA, J.
