% 12.07.2017 The petitioner seeks interim bail for four weeks for the purposes of getting her son admitted to either British Boarding school or any other boarding school.
The petitioner is facing trial in a case of murder. In the aforesaid trial, out of 46 witnesses, only 9 have been examined till date. The petitioner is being tried for the murder of a maid servant who was working in her house. Dr.M.P. Singh, APP has, however, opposed the grant of interim bail on the ground that no details have been provided by the petitioner regarding which boarding school is the petitioner interested in getting her son admitted to.
Learned counsel for the petitioner has submitted that the first effort of the petitioner would be to get her son admitted in British Boarding school and if that is not possible, then any other boarding school in Delhi. He has
also stated, on instructions, that the son of the petitioner is now staying with her maternal grandparents and it is really necessary for her to come out of jail for some time so as to enable her to get her son admitted to a boarding school for his better future.
Taking into consideration the aforesaid facts, this Court is inclined to release the petitioner on interim bail for a specified period. Let the petitioner be released on interim bail for a period of four weeks, to be counted from the date of her release, on her furnishing a bond in the sum of Rs.20,000/- with one surety of the like amount to the satisfaction of the Trial Court.
Needless to state that the petitioner shall, on the expiry of the above period of interim bail, surrender positively before the jail authorities. The application is disposed of.
