1. In terms of the arbitration clause in the contract, the Respondent has appointed its Arbitrator which has been objected to by the Petitioner. The Petitioner insists that a neutral Arbitrator be appointed.
2. Having heard learned counsel for the parties, the Court is of the view that it would be appropriate to have a neutral Arbitrator to adjudicate the disputes between the parties. This is also consistent with the spirit of the Arbitration and Conciliation Act, 1996 as amended with effect from 23rd October, 2015.
3. The Court, accordingly, appoints Mr. Charanjit Jawa, a former Additional District Judge, residing at 229, Vivekanand Puri, Near Shastri Nagar Metro Station, Delhi-110007 (Mobile No. 9811092067) as an Arbitrator to O.M.P.(T) 26/2015
adjudicate the disputes between the parties including their claims and counterclaims. The learned Arbitrator shall fix his own terms and communicate them to the parties. The parties in the first instance will appear before the learned Arbitrator on 22nd November, 2016 at 4.30 pm at a venue to be fixed by the parties (and to be intimated to the Arbitrator one week in advance).
