% 09.11.2016 This is a petition under Section 482 Cr.P.C. for quashing of the FIR No.0153/2016 under Sections 420/34 IPC, registered at PS Keshav Puram as the dispute between the parties has been settled amicably.
Learned counsel for the petitioners submits that the petitioners and the complainant are dealing in business of grains i.e. pulses. He further submits that due to misunderstanding between the petitioners and the complainant with respect to non reaching of goods at proper time, complainant registered FIR No.0153/2016 under Sections 420/34 IPC PS Keshav Puram.
It is further submitted that after registration of the FIR, near friends of business community interfered into the dispute and settled the matter amicably between the petitioners and the complainant for betterment of the society of the business class. It is further submitted that the matter has been settled
vide settlement deed dated 17.10.2016.
Learned counsel for the petitioners further submitted that the settlement was volunteer and nothing is left to be adjudicated between the parties and prays that FIR No.0153/2016, under Sections 420/34 IPC PS Keshav Puram be quashed.
Complainant is present in person and is identified by the IO SI Suraj Pal. It is submitted that the matter has been settled amicably with the intervention of friends of business community and same has been done for the betterment of relationship in business community and after the settlement till date, the parties are having cordial relations. It is further submitted that the complainant has no objection if the aforementioned FIR is quashed to meet the ends of justice. Looking into the facts and circumstances and for the betterment of relationships between the parties in the near future, FIR No.0153/2016, under Sections 420/34 IPC registered at PS Keshav Puram is quashed and the instant petition is disposed of accordingly. Petitioners, who are stated to be in JC in this case, be released if not required in any other case.
