+ CRL.M.C. 4936/2018, CRL MA 33037-38-2018 PRADEEP DAGAR ..... Petitioner Through Mr. A K Sharma, Adv versus THE STATE ( GNCT OF DELHI) & ORS ..... Respondents Through Mr. Izhar Ahmad, APP for State SI Sanjeev, PS Vasant Kunj (South) R-2 in person

CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 27.09.2018 Notice.

learned APP accepts notice on behalf of State. Respondent no.2 Ishwari Devi is present in Court and accepts notice. She has been identified by SI Sanjeev of police station Vasant Kunj (South).

Petitioner and respondent no.2 are neighbours.

FIR No.313/2013 under Sections 354/354A/45 IPC was registered at police station Vasant Kunj (South) on the complaint of respondent no.2. It is submitted that petitioner and respondent no.2 have now settled their disputes amicably, therefore, aforesaid FIR may be quashed.

Respondent no.2 submits that she has settled the matter with the petitioner of her own free will and without any undue force, pressure or coercion and has no objection in case the aforesaid FIR is quashed

against the petitioner.

Keeping in mind the settlement arrived at between the petitioner and respondent no.2 voluntarily, in my view, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, aforesaid FIR and consequent proceedings emanating therefrom are quashed.

Petition is disposed of in the above terms.

Miscellaneous applications are disposed of as infructuous. Dasti. A.K. PATHAK, J SEPTEMBER 27, 2018 sm
