Learned counsel for the petitioner states that when the present petition was filed the application seeking parole has not been adjudicated, now the same has been rejected vide the communication dated 27th December, 2016. Learned counsel for the petitioner seeks leave to withdraw the present petition with liberty to file a fresh petition challenging the communication dated 27th December, 2016.

Petition is dismissed as withdrawn.
