The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.1/2013 registered under Section 380 IPC at PS Crime Branch, New Delhi.

I have heard the learned counsel for the parties and have examined the file. On perusal of the file it reveals that earlier similar Bail Application 359/2014 was filed by the petitioner for seeking anticipatory bail. By an order dated 03.04.2014 (page 18) the said application was dismissed on merits. The petitioner did not challenge the said order.

The said bail application was dismissed observing that proceedings under Section 82 Cr.P.C. were complete and the petitioner along with his associate was absconding. Considering the severe allegations against the petitioner, he was not granted anticipatory bail.

There is no change of circumstance to consider the second anticipatory bail application almost on similar grounds. 4.

The bail application is dismissed.
