O R D E R
% 24.01.2020 The matter had been heard at substantial length yesterday. We had encouraged the parties to settle the disputes - with the appellant being paid a further amount of Rs. 3 Lakhs by the respondents, over and above all other amounts received by him, including towards gratuity, retrenchment compensation, and under the settlement. The appellant was agreeable to receive the said amount. However, adjournment was sought on behalf of the respondents to enable the respondents‟ counsel to take instructions. Today, learned counsel for the respondents states that the respondent is agreeable to make payment of an additional amount of Rs. 3 Lakhs to the
appellant in the aforesaid terms, without prejudice to its rights and claims in respect of all other employees. The appellant, who is present in Court with his Counsel, is also agreeable to the said settlement. We, therefore, dispose of this appeal, as settled. The respondent shall make payment of Rs. 3 Lakhs to the appellant within one week from today. The said payment shall be made in full and final settlement of all outstanding claims of the appellant, and no deduction/ adjustment shall be made therefrom. This settlement has been arrived at in the facts of the present case, and shall not form a precedent. The appellant states that he does not have any other claim pending against the respondent and shall not pursue any other claim against the respondent, in any pending proceedings, and that he shall not file any proceedings against the respondent in respect of any claim. This settlement and the statement aforesaid shall bind the parties. The appeal stands disposed of in the aforesaid terms. Dasti.
