% 03.08.2017 On 11.05.2017, we had recorded the following statement made on behalf of the petitioner:- "Learned counsel for the petitioner has submitted that there is no Presiding Officer and the Supporting Officer is appearing as the Presiding Officer. She states that the petitioner has no objection in case the respondents appoint a Presiding Officer and continue with the complaint proceedings. Counsel for the respondents would obtain instructions in this regard." Learned counsel appearing for official respondent submits that they have been in touch with the complainant (name withheld) and she has agreed to the following:
"I have no objections if a Presiding Officer is appointed in addition to the SSO (Shri S.C. Jha, DC Retd) already appointed
and if my SSO is not restricted from presenting my case in the proceedings and making submissions on my behalf in the proceedings."
Learned Senior counsel appearing on behalf of the petitioner submits that in view of the aforesaid statement they are satisfied. Learned Senior counsel appearing on behalf of the petitioner submits that some other questions/issues are raised in the present writ petition and those would be raised in accordance with the law before Inquiry Officer or Disciplinary Authority.
Without expressing any opinion on merits on any question, we dispose of the present writ petition as well as pending application in view of the communication/letter of complaint as well as statement made on behalf of the petitioner.
