O R D E R

% 02.12.2016 The status report tendered in court is taken on record. The petitioner has preferred the present petition to seek parole so as to enable him to prefer a Special Leave Petition before the Supreme Court against the dismissal of his appeal by this Court. The petitioner is a convict in the case FIR 303/2000 under Section 364A/120B IPC. He is undergoing a life sentence. The petitioner has already undergone incarceration for 9 years and 8 days as on 11.10.2016. The nominal roll on record shows that the conduct of the petitioner is satisfactory. The petitioner had provided his local address. As per the status report, none of his relatives reside at the local address. In this regard, the statements of Joginder Pal, s/o Kishori Lal and Kanta Sharma,

w/o Satpal have been referred to in the status report. The petitioner's home town address at Maharashtra has also been verified. Ms.Vohra submits that after the preparation of the status report, the said address of the petitioner has also been got verified. His elder brother Vishnu Shankar Wagle is residing with his family at the said address. In view of the aforesaid, I am inclined to allow the petition. In these circumstances, the petitioner is directed to be released on parole for a period of 30 days subject to:

i) his furnishing personal bond with one surety in the sum of Rs.10,000/- to the satisfaction of the Jail Superintendent; ii) he shall provide his mobile phone number to the Jail Superintendent at the time of his release, which shall be kept in working condition at all times. The same shall not be changed without prior intimation to the Jail Superintendent;

iii) he shall report at the local police station to mark his attendance on every Monday at 11:00 a.m. during the period of parole; iv) he shall duly surrender at the end of the period of parole; and v) he shall also not indulge in any criminal activity while on parole. Dasti.
