% 15.11.2016 By the present petition the petitioner seeks interim bail on the ground that his wife is unwell.
A verification report has been filed. As per the verification report the wife of the petitioner was suffering from tumour in the uterus for which surgery was performed on 21st October, 2016. The petitioner was granted interim bail by the learned Trial Court from 20th October, 2016 till 29th October, 2016 where after petitioner surrendered. The petitioner now seeks further interim bail on the ground that postsurgery complications having been developed he is required to be with his wife as besides the wife there are two small children to be looked after and BAIL APPLN. 2283/2016
since marriage between the petitioner and his wife was a love marriage, the family members do not cooperate with them. Though the factum that the family members do not cooperate with the petitioner and his wife is disputed by the learned APP for the State because as per the status report on the last occasion when she was unwell her brother-in-law got her admitted in the hospital, however the fact that the wife of the petitioner has developed postoperative complications which need treatment has been verified. Considering the facts and circumstances of the case the petitioner is granted interim bail for a period of two weeks on his furnishing a personal bond in the sum of ₹50,000/- with two sureties of the like amount subject to the satisfaction of the learned Trial Court. It is clarified that no further extension of interim bail will be granted on this ground. Petition is disposed of. Order dasti.
