O R D E R

% 21.08.2018 The present petition seeking initiation of contempt against the respondents is predicated on the violation of the directions contained in the order and judgment dated 26.08.2016, passed by this Court in O.M.P.(I)(COMM.) 153/2016 titled as 'Benara Bearings & Pistons Ltd. vs. Mahle Engine Components India Pvt. Ltd.'; whereby the respondent/'Benara' was directed to bear the demurrage charges for the said container from 29.04.2016 till 26.08.2016, the date of the subject order.

It is an admitted position that, the demurrage charges for the subject container for the afore-stated period are in the sum of Rs.13,91,807.6/-.

Mr. K.K. Sharma, learned Senior Counsel appearing on behalf

of the 'Benara' has handed over in Court today, a demand draft bearing No.

"001110", dated 18.08.2018, in the sum of Rs.13,91,808/- in favour of 'Mahle Engine Components India Pvt. Ltd.' to Mr. Sudhir Sharma, learned counsel appearing on behalf of the petitioner.

In view of the foregoing, since the directions contained in the order and judgment dated 26.08.2016 have been complied with, albeit belatedly, no further directions are called for in the present proceedings.

The present petition is disposed of accordingly and the pending application also stands disposed of.

The date already fixed stands cancelled.
