After arguments, this appeal is disposed of with the consent order that the appeal is disposed of as not pressed but the respondent no.1 will pay to the appellant a sum of Rs.4 lacs alongwith interest at 12% per annum simple from 15.11.2006 till the date of payment, and which payment shall be positively made by the respondent no.1 to the appellant within a period of two months from today. In case, payment is not made within two months from today, then the appellant will be entitled to interest at 18% per annum simple on the amount of Rs.4 lacs from 30.10.2006. 2.

Accordingly, this appeal is disposed of with the aforesaid consent order by sustaining the impugned judgment but ordering the payment as

stated above from the respondent no.1 to the appellant. Whatever amount which has been deposited by the respondent no.1 either in this Court or in the trial court be released back to the respondent no.1 alongwith accrued interest thereon if any.
