% 13.01.2017 By the present petition the petitioner seeks anticipatory bail in case FIR No. 267/2016 under Sections 323/341/308/506/34 IPC registered at PS South Rohini on the complaint of Sanjeev Kumar. In the FIR the complainant alleged that on 20th July, 2016 there was an argument between the sister-in-law Pawvati Devi and her son Naveen and his father Govind on the issue of parking which led to the quarrel. On 22nd July, 2016 when he was standing outside his house he saw that Manish was coming on his motor-bike. Manish stopped in front of their house and asked Parwati to withdraw the complaint or else she would face consequences. Since the complainant's sister-in-law refused to accede to the demands of Manish, he threatened her of dire consequence. After some time he came BAIL APPLN. 2306/2016
along with Naveen, Ankit and Ishant with iron rod and sticks. The four of them abused his sister-in-law. Despite the fact that the complainant tried to pacify the matter they did not relent and assaulted him with iron rod and wooden sticks.
The injuries received on all the three victims have been opined to be simple in nature. The two other co-accused have already been granted anticipatory bail.
Considering the nature of allegations and the fact that the petitioner is not involved in any other offence, this Court deems it fit to grant anticipatory bail to the petitioner. It is therefore directed that in the event of arrest the petitioner be released on bail on his furnishing a personal bond in the sum of `25,000/- with one surety of the like amount subject to the satisfaction of the Arresting Officer/ SHO concerned, further subject to the condition that he will join the investigation as and when directed and will not leave the country without the prior permission of the Court concerned. Petition is disposed of. Order dasti.
