By this petition, the petitioner seeks interim bail on the ground that his mother is suffering from breast cancer and is in the advance stage at the moment. Thus, the petitioner needs to take care of his mother and be with his mother at this time.

A status report has been filed verifying the factum of the mother of the petitioner suffering from breast cancer for the last four years and is now at an advance stage and she has been advised to be admitted in the hospital to undergo palliative left MRM with skin flap latissmus dorsi muscle flap surgery. The petitioner's family comprises of his mother, wife, two brothers, one of whom is married and has a small child aged two months. BAIL APPLN. 2146/2018

The petitioner has been in custody since 16th June, 2013 and except for an interim bail for a period of 5 days at the time of marriage of his brother, the petitioner was not released on bail. However, the petitioner did not misuse the said concession of 5 days' bail granted to him. 3.

Considering the condition of the petitioner's mother as also the fact that earlier interim bail was not misused by the petitioner as also the fact that the eye witness who remains to be examined is presently not in the country, this Court deems it fit to grant interim bail to the petitioner. It is, therefore, directed that the petitioner be released on interim bail for a period of four weeks on his furnishing a personal bond in the sum of `25,000/- with one surety bond of the like amount subject to the satisfaction of the learned Trial Court.
