% 14.02.2017 We have heard the counsel for the parties.

The only question that arises in the present appeal is with regard to the framing of issue no.(ii). After hearing the counsel for the parties and as agreed by them issue no.(ii) is re-framed as under:- "Whether the plaintiff was and has been in lawful constructive possession of the suit property and as such is required to pay only fixed court fees? OPP."
