This petition has been filed impugning order dated 01st June, 2017 passed by the Principal Districts and Sessions Judge in Transfer Petition Criminal No.12/2017. By the said order, the Hon'ble Judge noted that two cases, namely, Complaint Case No.170/K/10 and proceedings arising out of an FIR No.118/2010 arise out of the same incident and it would be desirable if the both the cases are heard by one Court in order to avoid any conflict of decisions.

During the pendency of the matter, the trial in both the matters have substantially progressed and in particular in the trial relating to the FIR it is at the last concluding stage.

Moreover, counsel for the respondent points out to the decision of the Supreme Court in Nathi Lal & Ors. v. State of U.P. & Anr., {1990 (Supp.) SCC 145} where the Court had said that Judge must try both the cross-cases one after the other.

In this view of the matter, there is nothing infirm with the impugned order.

Accordingly, the petition is dismissed.
