% 25.10.2017 I.A.No.12337/2017 Present application has been filed under Section 148 and Order XXVI Rules 4, 9 and 10 CPC for extension of time in complying with the provisions of Order XXXIX Rule 3 CPC.

Learned counsel for the plaintiff states that one of the Local Commissioners Mr.Ketan Paul has indicated that he is unavailable till 10th November, 2017.

Keeping in view the urgency in the matter, the time period for compliance of the provisions of Order XXXIX rule 3 CPC is extended by ten days and Mr.Surinder Singh, Advocate, Mobile No.9311325398 is appointed as Local Commissioner in place of Mr.Ketan Paul for conducting the commission.

Accordingly, the application stands allowed.
