+ CONT.CAS(C) 1196/2016 & CM No. 42062/2016 Y NOORUDDIN ..... Petitioner Through:

Mr. C.Rajaram, Advocate.

versus S.K SHARMA, REGISTRAR, IGNOU ..... Respondent Through:

Mr. Kirtiman Singh and Mr. Pranav Agrawal, Advs.

CORAM:

HON'BLE MR. JUSTICE VALMIKI J. MEHTA

O R D E R

% 17.11.2016 1.

It is unfortunate that litigants are advised to file a totally frivolous petition. This contempt petition is one such petition. Contempt is alleged of the order passed by a learned Single Judge of this Court on 28.9.2016 and which only directs maintenance of status quo and does not grant status ante. This is in fact not only clear from the last line of the order dated 28.9.2016 but also from the two earlier paras of the order which state that petitioner has already been reverted to the original post. Petitioner was reverted by the order of the respondent dated 22.8.2016 and the learned Single Judge of this Court who passed the order dated 28.9.2016 did not stay the operation of the order dated 22.8.2016 which has been challenged in the writ petition. The

petitioner by this contempt petition seeks to bite more than he can chew and in fact the contempt petition is not only misconceived but petitioner has been ill-advised to file the same.

Dismissed.
