% 09.08.2017 The respondent is the daughter of the petitioner, who had asked for maintenance from the petitioner, her father, who has abandoned her. It has been submitted on behalf of the respondent that after the petitioner obtained divorce from the mother of the respondent, he married another woman and with whom he has four children.
The Family Court has directed the petitioner to pay Rs.1 lakh to the respondent in order to enable her to pursue her studies effectively. By the present revision petition, the aforesaid order has been challenged. The petitioner, apart from his financial incapability of paying the maintenance, has also raised the issue of the paternity of the respondent. The Family Court, after taking into account all factors specially that the mother of the respondent was divorced by the petitioner, whereafter he married again, came to the conclusion that the respondent is the daughter of the petitioner.
Apart from the aforesaid evidence, the Family Court also
took note of the fact that the admit card and high school examination mark sheet of the respondent which were issued in the year 2011 also bore the name of the petitioner as her father.
This Court does not find any anomaly with the order passed by the Family Court.
The present revision petition is, therefore, dismissed. ASHUTOSH KUMAR, J AUGUST 09, 2017 ns
