% 01.12.2016 The present petition has been filed by the petitioner under Article 226 of the Constitution of India read with Section 482 Cr.P.C. being aggrieved by the order dated 04.08.2016 passed by the competent authority vide which the request of the petitioner to release him on parole was rejected.
Status report was filed by the Govt. of NCT of Delhi. From the status report filed by the Govt. of NCT of Delhi, it reveals that they have been able to find out the address of Mithu Lal @ Fanni Lal Mandal.
Undisputedly, the fact before the competent authority at the time of considering the request was that the address of Mithu Lal was not verified and keeping in view the same, apart from other things kept in mind, the application for parole was rejected.
In the changed circumstances, this case needs to be reconsidered in view of the fact that address has already been verified. The present petition is disposed of with the direction to the competent authority to pass order afresh within a period of 30 days from today keeping in view the verification report.
