% 30.05.2017 Present petition is filed under section 15 of the Arbitration and Conciliation Act,1996 for appointment of a substitute Arbitrator in view of the resignation by the previous Arbitrator Justice A.P.Shah (Retd.). The parties have entered into an agreement on 28.6.2016 for sale, transfer, conveyance, assignment of 1⁄2 (one-half) of the total rights, title, interest and entitlements in the plot of land and the proposed project/complex to be constructed on a leasehold plot of land situated at Rajender Place, New Delhi.

As disputes arose between the parties, Arbitration Petition was filed. On 19.3.2012 with the consent of the parties this court appointed Justice A.P.Shah (Retd.) as a Sole Arbitrator to adjudicate the disputes. The learned arbitrator has resigned on 15.11.2013. Notice was issued to the respondents. Office report says that notice by ordinary process has been served. However, none is present for the respondent.

In view of the above, Mr.Justice Nisar Ahmad Kakru (Retd.), R/o M-

28, Greater Kailash-II(Market), 3rd Floor, New Delhi-110 048 (Mobile No.9419000938) is appointed as an Arbitrator. The learned Arbitrator will fix his fees in consultation with learned counsel for the parties. Petition stands disposed of. Copy of this order be sent to the learned Arbitrator.
