% 14.12.2016 Petitioner no.1 and respondent no.2 are husband and wife. They have resolved their differences before the Family Court, Karkardooma Courts, Shahdara, Delhi on 20th May, 2015 in Suit/Case Ex. No.937/2014. It is submitted that petitioner no.1 and respondent no.2 are living together since May, 2015.
Respondent no.2 is present in Court along with her counsel. She submits that she is not willing to pursue the FIR any further in view of the settlement.
Keeping in mind that husband and wife have resolved their differences and have started living together, no fruitful purpose would be
served to keep them entangled in criminal proceedings. Accordingly, FIR No.776/2013 under Sections 498A/406/34 IPC registered at police station Nand Nagri, which is at the investigation stage, is quashed. Petition is disposed of in the above terms. Miscellaneous application is disposed of as infructuous.
