% 03.11.2017 Instant petition has come to be filed alleging violation of the order dated 24th August, 2016, whereunder, respondent-SDMC was required to take action against unauthorised constructions. As per the status report dated 3rd August, 2017, it is stated as follows:- ".. that pursuant to demolition order already passed in respect of the property in question, it is submitted that the department has taken / carried out further demolition action on dated 12/07/2017 and 2/08/2017 as per the following details:- SNo Date of Action Action taken 12/07/2017 Upon availability of police force demolished main side walls at third floor, 2 ain side walls at second floor and remaining
RCC roof of third floor.
02/08/2017 Upon availability of police for demolished remaining RCC slabs at ground, first, second and third floor on its front side The photographs of the above referred demolition actions are also annexed herewith as Annexure - 'A' (Colly).
3. That further, upon taking the above referred demolition actions in respect of the property in question a letter has also been written to the concerned SHO vide bearing no.D/14242/B-I/SZ/2017 dated 02/08/2017 with the request to instruct that patrolling staff to keep strict vigil at site so that the owner/builder shall not restore the demolished portion or raise further construction or occupy the same. The copy of said letters as issued are annexed herewith as AnnexureB.
4. That it is further stated that s can also be observed from the above demolition action/photographs annexed that presently the property in question has been made uninhabitable / beyond use."
In view of the action stated to have been taken, contempt petition is disposed off.
