O R D E R

% 06.09.2017 Ms.Garima Sharma, learned advocate appearing for the revisionist/ petitioner submits that under the aegis of the Delhi High Court Mediation and Conciliation Centre, the entire dispute has been settled. She has also drawn the attention of this Court to the terms of the settlement which are as under:

"Settlement points It is agreed between the parties that:

i.

First Party being a Joint owner of Third Floor Property at B-139, 3rd Floor, Madhuban, Delhi110092, would transfer her share in favour of her Son Mr.Naresh Khurana (Co-owner of said property). Second Party undertakes to pay a sum of Rs.1.30 Crores (Rupees One Crore and thirty Lacs) to First Party, out of which a sum of Rs. 1.20 Crores (inclusive of Registration amount before the sub Registrar) would be spent to purchase a Flat being a

Upper Ground Floor of House No.68, admeasuring 133.33 Sq.Yards of Kailash Hills, New Delhi along with 2 ACs and a Double Bed along with, Mattresses and a washing machine. Apart from the purchase of this house, a sum of Rs.10 lacs separately would be paid to the Mother.

ii.

Second Party would only transfer the settled amount of (Rs.1.20 C.) on instructions of the First party. In no case whatsoever, the Second Party shall not be responsible for indemnifying the First Party, in case the title of the property is not clear.

iii.

Apart from the above, effective from the date of signing of present Agreement a monthly maintenance of Rs.19,000/- (Nineteen thousand only) would be paid by the Second Party to the First Party.

This amount would be credited on or before 10th of each month in Bank A/c No.095210000657 at Dena Bank, Laxmi Nagar, New Delhi.

In light of this settlement steps would be taken by the First Party to withdraw the following cases, viz. - Case pending before District Magistrate bearing No.F.PA/DM (E) Maintenance Tribunal/09/2014/3758-60.

- DV case, bearing No.109 of 2015 under provisions of Protection of Women from Domestic Violence Act, pending before the Court of MM(Mahila) Court at Karkardoma, Delhi.

- Criminal Revision No.745 of 2016, pending before Hon'ble Delhi High Court.

- Both parties would prefer a joint petition for quashing of FIR number 224 of 2015 U/s 323, 341, 506 and 34 IPC registered at PS Preet Vihar, New Delhi and the first party shall co-operate in such quashing of the FIR."

Learned counsel for the petitioner, therefore, submits that there is no need to press the present revision petition.

As such, a prayer has been made for withdrawal of the present revision petition.

The prayer is allowed.

The Criminal Revision Petition no.745/2016 is dismissed as withdrawn.
