% 01.02.2017 Registrar, Cooperative Societies has filed an affidavit enclosing therewith copy of order dated 25th October, 2016 passed by the Financial Commissioner. As per this order, the matter stands remanded to the Registrar, Cooperative Societies with a direction to carefully examine the matter in view of the rules, documents produced, record/documents of revenue department and supportive documents.

In these circumstances, the petitioner's grievance and complaint would be duly noticed and taken into account by the Registrar,

Cooperative Societies. We would also permit the petitioner to make a representation to the Registrar, Cooperative Societies within a period of 15 days from today in support of his submissions. 3.

Counsel for the respondent No.3 submits that the respondent No.3 does not have any intention of transferring, alienating or disposing of the flat in question without the issue being resolved and settled by the Registrar, Cooperative Society. This means that the respondent No.3 would not enter into agreement-to-sell without permission of the Registrar, Cooperative Societies or the issue being resolved and settled. We take the statement made on record. 4.

The Registrar, Cooperative Society will examine the whole issue expeditiously and preferably pass an order on or before 21st April, 2017.

With the aforesaid observations, the writ petition is disposed of clarifying that this Court has not expressed any opinion on merits. Dasti.
