On the last date of hearing, counsel for the respondent on verbal instructions had stated that Rajesh Kapoor has obtained stay order from the Financial Commissioner.

Today, counsel for the respondent has furnished relevant papers including the order passed by the Financial Commissioner in Case No. 444/2012 filed by the Rajesh Kapoor.

Learned counsel for the petitioner submits that he would move an appropriate application for impleadment and vacation of stay before the Financial Commissioner. Accordingly, he would withdraw
the present writ petition.

We dismissed the writ petition as withdrawn in view of the statement made by the counsel for the petitioner giving liberty to the petitioner to move an appropriate application(s) before the Financial Commissioner.
