The petitioner seeks anticipatory bail under Section 438 Cr.P.C. in case FIR No.375/2016 registered under Sections 304B/34 IPC at PS Khayala. Status report is on record.

I have heard the learned counsel for the parties including the counsel for the complainant and have examined the file. 3.

By an order dated 25.01.2017, the petitioner was granted interim protection and was directed to join the investigation as and when required.

By an order dated 15.02.2017, he was directed to return dowry articles including vehicle bearing No.DL9CU 9276 (Honda Mobilio) to the victim's father.

In compliance of the said orders, the vehicle bearing No.DL9CU 9276 (Honda Mobilio) has since been delivered to the victim's father. It is informed that all the dowry articles have not so far been returned.

As per post-mortem report, the victim's death was natural due to medical complications.

During arguments, learned counsel for the petitioner, on instructions, volunteered to pay `4 (Four) lacs to the complainant / victim's father without prejudice and subject to future adjustment (if any) towards dowry articles.

On this, learned counsel for the complainant has no objection to the grant of anticipatory bail. 7.

Considering the facts and circumstances of the case and the petitioner's offer to pay `4 (Four) lacs to the complainant without prejudice and subject to future adjustment, he is granted anticipatory bail and in the event of arrest, he be released on furnishing personal bond in the sum of `40,000/- with one surety in the like amount to the satisfaction of the SHO/Investigating officer. He shall join the investigation as and when required and pay `4 (Four) lacs to complainant within a month through Investigating Officer by way of Demand Draft. This payment shall be without prejudice and subject to future adjustment (if any).

In case of non-compliance, the complainant / State will be at liberty to approach this Court.

The bail application stands disposed of.
