BAIL APPLN. 1246/2015, BAIL APPLN. 1247/2015 & BAIL APPLN. 1248/2015 By the present bail applications, the petitioners seek transit bail fearing arrest with respect to the FIR filed under section 498A, 323, 504 IPC registered at P.S. Kotwali Nagar, Aligarh, U.P. By:AMULYA
r?5-) Counsel for the petitioners submits that the father-in-law of the complainant is 74 years of age and is a heart patient and his wife has just undergone a surgery and the husband of the complainant is the only male member in the family, who is looking after the ailing parents. Counsel also submits that out of fear of being arrested and on account of medical condition of the two petitioners, they did not attend the mediation proceedings, however, they undertake to attend the mediation proceedings on a date which would be fixed.
Learned APP for the State submits that petitioners have failed to file a copy of the notice issued under Section 41(A) of the Cr.P.C.. Counsel for , the petitioners submits that the petitioners are being threatened on telephone that they will be arrested which has prompted them to file the present bail applications. Counsel prays for protection for one month to seek appropriate remedy.
Having regard to the fact that the FIR arises out of a matrimonial dispute and the submissions made today and the old age of the two petitioners, the petitioners shall not be arrested for a period of ten (10) days from 25.06.2015 to enable them to seek appropriate remedy as may be available in accordance with law in the appropriate court of jurisdiction. The petitions stand disposed of.
