O R D E R
% 19.04.2017 This is a petition under Section 482 Cr.P.C. for quashing of FIR No.382/2007, under Section 4 of Dowry Prohibition Act, registered at Police Station Sangam Vihar, New Delhi and all proceedings emanating therefrom. Learned counsel for the petitioners submits that the petitioner No.1 Habi Ram @ Dhan Singh was proposed to get marry with the daughter of the respondent No.2 Nihal Chand and the date of the said marriage was fixed. Counsel further submits that on the date of the marriage, due to misunderstanding arisen between the petitioners and the respondent No.2, the marriage could not be performed which resulted into the registration of the aforesaid FIR. Counsel further submits that after the registration of the FIR, the near relatives and the friends intervened and the matter has been amicably settled between the parties and the misunderstanding between the parties was sorted out and the daughter of the respondent No.2 also got married with some other person. Counsel further submits that the petitioners
and the respondent No.2 want to maintain the same healthy relations as in the past. Counsel further submits that since the matter has been amicably settled between the parties and nothing further remains to be adjudicated between the parties, however, the FIR in question is coming as hurdle in the way of the present petitioners. He accordingly prays that the FIR in question and all proceedings arising therefrom may be quashed. Respondent No.2 present in Court today and has been identified by the IO SI Ravi Kumar, P.S. Sangam Vihar, New Delhi. The respondent Nos.2 present in person admits that he has amicably settled the matter with the petitioners voluntarily and without any force, pressure or coercion. He further admits that the misunderstanding arisen between him and the petitioners has been sorted out and nothing further remains to be adjudicated.
He further submits that he has no objection if the FIR in question is quashed.
Keeping in view the above facts and circumstances, since the dispute has been amicably settled/sorted out between the parties and nothing remains to be adjudicated further between them, to have peace and maintain better relationship between them at present and in near future, I deem it appropriate to quash the FIR and all its subsequent proceedings.
Consequently, FIR No.382/2007, under Section 4 of Dowry Prohibition Act, registered at Police Station Sangam Vihar, New Delhi and all proceedings emanating therefrom are hereby quashed.
