% 17.12.2018 As per the report received, no application in terms of the proceedings dated 15.11.2018 has been filed on behalf of the appellant till date seeking waiver of the costs as imposed vide order dated 06.09.2018. The proof of costs in terms of order dated 06.09.2018 has also not been filed on behalf of the appellant nor is appellant present.

In terms of the order dated 06.09.2018 whereby it was observed to the effect that If the costs are not so deposited before the next date of hearing", which was the date 15.11.2018 on which date an application was sought to be filed, which has also not been filed, it had been observed to the effect that "the appeal shall stand dismissed for non-prosecution". The directions dated 06.09.2018 and the application sought to be filed in terms of the order dated 15.11.2018, have not been complied with by the appellant. Thus, in terms of the order dated 06.09.2018, LA.APP. 97/2017 is thus dismissed for non-prosecution.
