CORAM:

HON'BLE MR. JUSTICE A.K. PATHAK

% 17.01.2018 Learned senior counsel for the petitioner submits that petitioner is husband of the complainant.

After the marriage, complainant could not adjust in the family.

She has falsely roped the entire family, with the allegations of demand of dowry and her harassment by the petitioner. Complainant had been levelling false allegations that petitioner was having illicit relations with his sister-in-law (bhabhi). Petitioner did not demand any dowry nor harassed the complainant. Petitioner is living separately in the same house.

Petitioner has cooperated in the investigation. Petitioner was granted interim protection by this Court vide order dated 21st November, 2016, which is still continuing. Petitioner has not misused the

concession of interim protection granted to him. Learned APP, who is assisted by the counsel for the complainant, has opposed the grant of anticipatory bail to petitioner. It is contended that specific allegations have been levelled against the petitioner in the FIR. Petitioner had been demanding `50 lacs from the complainant. Petitioner would also give beatings to her.

Complainant was thrown out of the matrimonial home by the petitioner.

She was put back in the possession by the police with the help of a NGO. Learned APP submits that investigations are over and charge-sheet would be filed within four weeks. Keeping in mind the totality of the facts and circumstances, it is ordered that in case of arrest petitioner be released on bail, subject to his furnishing a personal bond in the sum of `20,000/- with one surety in the like amount to the satisfaction of the Investigating Officer/Arresting Officer/SHO of the concerned police station.

Bail application is disposed of in the above terms. Dasti.
