O R D E R

% 29.03.2016 I.A. No. 4043/2016 This application has jointly been moved by the parties to record their settlement. The application is signed by the parties and their respective counsel. It is also supported by the affidavit of Ms. Sipra Seth, the authorised signatory of plaintiff No.1 and the power of attorney holder of plaintiff No.2, and the affidavit of Mr. Jatin Gulati, the legal counsel with defendant No.3 and authorised representative of the defendant No.3. Along with the application, the parties have placed on record the settlement agreement arrived at between them on 16.03.2016, which forms the basis of the present application. The application also states that the plaintiffs

withdraw the suit against the other defendants, i.e. defendants No.1, 2, 4 &

5. The terms of settlement appear to be fair, just and reasonable and there is no impediment in accepting the same.

Accordingly, the suit is disposed of as settled in terms of the settlement agreement, which shall continue to bind the plaintiff and the defendant No.3. The suit stands dismissed qua the other defendants. Since the suit has been settled at an early stage prior to commencement of trial, the plaintiffs shall be entitled to refund of 50% Court Fees.
