% 03.05.2016 The present petition is filed under Section 9 seeking the following prayer :- "(a) That this Hon'ble Court may be pleased to direct the Respondent to take over the Project from the Applicant as per the terms of Article 37.4 of the CA."
The petitioner has admittedly terminated the contract. The learned counsel for the petitioner states that at the time of termination. Learned counsel for the respondent has submitted that in view of termination without prejudice, the respondent is ready to take over the project from the petitioner, as per the terms of Article 37.4 of the Concessional Agreement, for which the petitioner has no objection.
While taking over the said project, the parties will co-operate with each other.
The present petition is disposed of accordingly. MANMOHAN SINGH, J.
