The present suit has already been decreed on 31st July, 2024 in terms of the settlement agreement dated 23rd April, 2024 between the plaintiffs and the defendant no.2.

Counsel for the plaintiffs submits that he has instructions not to pursue the present suit qua the defendant no.1 with liberty to file a fresh suit against the defendant no.1, if a fresh cause of action arises. 3.

Accordingly, the present suit is dismissed as not pressed with the aforesaid liberty.
