W.P.(CRL) 3313/2016 Petitioner is not a commercial driver. While driving his car, he hit an auto-rickshaw, resulting in injuries to the respondent nos. 2 and 3. This incident led to the registration of the present FIR No.147/2016 under Sections 279/337 IPC at Police Station Parliament Street on the complaint of

respondent no. 2. Respondent no. 4 was also travelling in the same auto but he has not sustained any injury. Petitioner and respondent nos. 2 to 4 have settled their disputes vide Deed of Compromise dated 29th October, 2016. Respondent nos. 2 and 3 have been suitably compensated towards medical expenses, mental pain and agony.

Respondent nos. 2 to 4 are present in Court and submit that they have settled the matter with petitioner of their own free will and without any undue force, coercion and pressure. Respondent nos. 2 and 3 admit that they have received the settled amount. They further submit that they are not willing to pursue the FIR any further. Keeping in mind the fact that settlement has been arrived at between the petitioner and respondent nos. 2 to 4 and the nature of offence, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.147/2016 under Sections 279/337 IPC registered at Police Station Parliament Street and the consequent proceedings emanating therefrom are quashed. Petition is disposed of in the above terms.
