O R D E R

After some arguments, learned counsel for the parties submits that the present petition can be disposed of with a direction to the petitioner to continue to pay Rs.13,000/- per month as maintenance to the respondents from the date of filing of the application, without prejudice to their rights and contentions.

Learned counsel for the petitioner, on instructions from the petitioner who is present in the Court, submits that the entire arrears with respect to the aforesaid amount shall be paid in three equal installments at the interval of four weeks.

The first installment shall be paid on or before 20.02.2020 and thereafter the second and third instalment shall be paid at intervals of four weeks.

It is clarified that the above arrangement is only an ad-interim measure and the same is without prejudice to the rights and contentions of both the parties.

It is also clarified that in case at the time of disposal of the maintenance petition the trial court reaches the conclusion that respondents are entitled for lesser or higher maintenance, the trial court would be at liberty to grant adjustment of the arrears either way. 6.

The petitioner is bound by the statement made in Court today. 7.

In view of the aforesaid submissions made by learned counsel for the petitioner, an undertaking be filed by the petitioner within a period of three days.

It is informed that the maintenance application was filed in the year 2014. The trial court shall make an endeavour to expedite the proceedings. 9.
