The petitioner had preferred an application for anticipatory bail in connection with the FIR No.423/2015 (PS Parshad Nagar). Anticipatory bail was sought on the ground that even though the FIR was lodged by the brother of the deceased, the name of the petitioner did not figure in the column of the accused persons. The accusation on petitioner was levelled much later by the brother of the deceased in his further statement.

The petitioner submits that he has been falsely implicated in the case. The status report has been filed.

However, it has been submitted on behalf of the State that the petitioner joined investigation on two occasions and the police is satisfied about his explanation.

Under such circumstances, the petitioner is directed to be released on bail, in the event of his arrest, on his furnishing personal bond in the sum of Rs.10,000/- with two sureties of like amount to the satisfaction of the arresting officer/SHO of the concerned police station, subject to the condition that he shall continue to support the investigating agency in concluding the investigation and would visit the police station as and when required by the IO/SHO.
