% 24.09.2018 Crl.M.A.32730/2018 (restoration), Crl.M.A.32731/2018 (delay) Though the grounds for absence on 24.07.2018 do not impress for the simple reason the website of the court would indicate the date fixed, having regard to the submissions made by the counsel for the petitioner, vis-a-vis the main petition, the delay in filing the application for restoration is condoned and the prayer for restoration is allowed.

Both the applications stand disposed of.

CRL.M.C. 4317/2016 and Crl.M.A.17967/2016 The learned counsel for the petitioner, on instructions, submits that he may be allowed to withdraw the present petition and the application filed therewith, assailing the order dated 31.08.2016 of the Metropolitan Magistrate, seeking liberty to approach the court of Sessions invoking its revisional jurisdiction to seek necessary relief in its regard. The prayer is granted. The petition and the application filed therewith are dismissed as withdrawn with liberty as prayed for is granted. R.K.GAUBA, J.
