% 30.01.2017 This petition had initially been preferred by the two petitioners, namely, Karan Kumar and Sarika, who claimed that they have got married out of their own free will, and which was not to the liking of respondent no.3, the father of petitioner no.2/ Sarika. They had preferred this petition to seek protection from respondent no.3.
However, when this was case was taken up for hearing on 30.11.2016, counsel for the petitioners stated that petitioner no.2 Sarika had been taken away by her father respondent no.3. In these circumstances, while issuing notice to the respondents and directing that petitioner no.1 be protected adequately, the production of petitioner no.2 was also directed.
Today, respondent no.3 is present with petitioner no.2. Mr. Kapoor points out that the school record of petitioner no.2 shows that she is a minor inasmuch, as, her date of birth is recorded as 01.04.1999. Petitioner no.2, who is present in court, states that she resides with her father/ respondent no.3 and she does not wish to go with petitioner no.1. Respondent no.3 further states and assures the court that he shall not in any manner harm or threaten petitioner no.1. He is bound by the said statement and undertaking given to this court.
In view of the aforesaid statement, the petition is disposed of leaving the parties to avail of the remedies that may be available to them in law. The beat constable of the area shall keep a watch on the situation to ensure that there is no breach of law and order or peace on account of any dispute between the petitioner no.1 and respondent no.3 Dasti.
