% 08.11.2017 At the outset, learned counsel for plaintiffs states that he wishes to delete the defendants No.4 and 5 from the array of parties. Accordingly, defendants No.4 and 5 are deleted from the array of parties. Let an amended memo of parties be filed within a period of three days.

I.A. 13103/2017 Today, the parties have filed a joint Compromise application under Order 23 Rule 3 read with Section 151 CPC being I.A. 13103/2017. Learned counsel for defendants No.1 to 3 has today handed over a Power of Attorney executed by defendant No.3 in favour of defendant No.2 as well as a Vakalatnama executed in his favour. The same are also taken on record.

It is pertinent to mention that the joint Compromise application has been duly signed by learned counsel for the plaintiffs and defendants as well as by the parties to the litigation.

Present application is also supported by affidavits of the plaintiffs and the defendants.

Both the learned counsel state that the matter has been compromised in accordance with the terms mentioned in the joint Compromise application being I.A. 13103/2017.

Both the learned counsel further assure and undertake to this Court that the parties shall comply with the Settlement terms mentioned in the aforesaid Compromise application.

The aforesaid statements, assurances and undertakings as well as undertakings given by learned counsel for the parties are accepted by this Court and parties are held bound by the same. This Court has also perused the Compromise application and is of the opinion that it is lawful.

Consequently, the suit is decreed in accordance with the Compromise application being I.A. 13103/2017, a copy of which is marked as Ex. C-1. Registry is directed to prepare a decree sheet accordingly. With the aforesaid observations, present application is allowed and the suit stands disposed of. The interim order dated 30th June, 2015 stands vacated.
