% 12.09.2017 This is an application under Section 439 Cr.P.C. filed on behalf of the petitioner seeking grant of regular bail in case FIR No.32/2013, under Sections 489-B/489-C/120 B IPC, registered at Police Station-Special Cell. Learned APP for State on instructions from the Investigating Officer has submitted that during the pendency of trial, the petitioner moved an application before the trial court pleading his guilt with prayer to take lenient view and the Trial Court ordered to release the petitioner from judicial custody in FIR No.32/2013, PS-Special Cell and FIR No.27/2013, PS-Special Cell, if not required in any other case. Counsel for the petitioner submits that since the petitioner has been ordered to be released from the judicial custody, he wishes to withdraw the present bail application as the same has become infructuous. In view of the submissions made by learned counsel for the petitioner, the present bail application is dismissed as withdrawn and disposed of accordingly.
