O R D E R

% 20.12.2016 After some submission, the learned counsel for the petitioner submits that the petitioner would like to settle the matter with the respondent if some time is given to the petitioner to vacate the suit property. The learned counsel for the parties are agreed that the petitioner shall vacate the suit property within 18 months from today, i. e. on or before 30.06.2018.

The learned counsel for the petitioner on instructions from the petitioner who appears in person undertakes that the petitioner shall vacate the tenanted property on or before 30.06.2018 and shall continue to pay agreed rent, electricity and water charges of the suit property. He also undertakes that the petitioner shall not sub-let or part with possession of the

suit property or cause any wilful damage to the suit property. In view of the above, the learned counsel for the petitioner shall file an affidavit of undertaking of the petitioner on the aforesaid terms within a period of three weeks from today.

The learned counsel for the respondent on instructions from the respondent who appears in person submits that in view of the affidavit of undertaking of the petitioner, the respondent shall not execute the eviction order till 30.06.3018.

In view of the above, the learned counsel for the petitioner submits that the petitioner does not press the present petition. The parties shall remain bind by the terms and condition as above. The petition stands disposed of as withdrawn. All the pending applications also stand disposed of.
