W.P.(C) 10976/2016 & C.M.No.42958/2016 Petitioner is aggrieved by the illegal and unauthorized construction which is being carried out at the behest of the statutory authorities and which has been permitted to private resondents i.e. respondent nos.5 to 9; this is stated to be carrying out in the revenue estate of Village Chhawla in Khasra No.38/18/2, 28/19/2, 38/22, 38/23/1 and 571 measuring 9 bighas 16 biswas. On advance notice, learned counsel for SDMC has put in appearance.
Petitoner submits that on an earlier complaint made by him the private respndents had stopped their activities for a couple of months; however, it has again come to their knowledge that the illegal activity is being permitted in the aforenoted agricultural plot for which complaint had been lodged on 12.3.2016; subsequent complaints had also been lodged on 05.4.2016 and the last complaint has been lodged on 15.10.2016.
Learned counsel for respondent no.2/SDMC submits that these complaints are all before the police authorities. The last complaint lodged before respondent no.2 is dated 05.4.2016. Learned counsel for respondent no.2 states that if any alleged illegal activity is being carried out at the aforenoted property action shall be taken against the same in accordance with law. This statement of respondent no.2/SDMC is taken on record. It is hoped and expected that this commitment shall be honoured in true letter and spirit. Respondent no.2 may take assistance of respondent no.3 (who is represented through counsel).
Needless to state that all actions will be taken after due intimation to the private respondents.
No further orders are called for in this petition. Petition disposed of.
