% 14.03.2018 Vide order dated 19th April, 2017, trial court has closed the opportunity of petitioner to lead defence evidence. Learned counsel for the respondent points out that opportunity of petitioner to lead defence evidence was closed since no evidence was led by the petitioner despite several opportunities granted to him. Learned counsel for the petitioner submits that only one witness has to be examined in the defence evidence. Without going into the rival contentions of both the parties, impugned order is set aside and one opportunity is afforded to the petitioner to lead defence evidence subject to, however, costs of `15,000/- to be paid by the petitioner to the respondent before the trial court on the next date of hearing.

Petition is disposed of in the above terms.

Miscellaneous application is disposed of as infructuous.
