% 14.12.2016 Crl.M.A.19309/2016 (Exemption) Allowed, subject to all just exceptions.
Application is disposed of.
W.P.(CRL) 3531/2016 Petitioner no. 1 and respondent no. 2 are husband and wife. They have resolved their differences and have started living together for the last two years. Respondent no. 2 is present in Court and has been identified by SI Roshan Lal, P.S. Ambedkar Nagar. She submits that she has settled the matter with the petitioner and is now living with him. Presently, respondent
no. 2 has no grievance with the petitioner.
She submits that she is not willing to pursue the FIR any further.
She further submits that she has settled the matter with the petitioner of her own free will and without any undue force, coercion and pressure.
Keeping in mind the fact that husband and wife have resolved their differences and have started living together, no fruitful purpose would be served to keep the criminal proceedings pending. Accordingly, in the interest of justice, FIR No.331/2014 under Sections 498-A/406/34 IPC registered at Police Station Ambedkar Nagar and the consequent proceedings emanating therefrom are quashed.
Petition is disposed of in the above terms. Dasti. A.K. PATHAK, J.
