% 29.11.2016 CM No. 44254/2016 On the last date of hearing, learned counsel for the petitioner sought time to file an application seeking amendment of the writ petition. The said application being CM No. 44254/2016 has been filed, wherein, in para 7, the following has been averred.

"7. That the petitioner humbly prays for the following prayer to be added in the prayer clause after granting permission for amendment of prayer clause by adding the following prayer in the prayer clause:- "Issue a Writ of Mandamus, or any other appropriate

Writs, Orders directing the Respondent No.3 to immediately process the application of the petitioner and grant accreditation to it from the academic session of 2016-17 without stressing for the submission of building completion certification."

On a specific query to the learned counsel for the petitioner, whether the petitioner shall confine the writ petition to the prayer as made in para 7 of the application for amendment as reflected above, the answer was in the negative.

He further states that he will withdraw the application and the writ petition with liberty to the petitioner to file a proper writ petition incorporating the prayer, as sought for in the present application. The writ petition and the connected applications are dismissed as withdrawn, with liberty as prayed for.
