% 02.04.2018 File is taken up today as 29.03.2018 was declared holiday. There is no appearance on the matter being called out on behalf of the petitioner. The counsel for respondent no.4 points out that the petition at hand was filed to challenge the judgment dated 09.04.2015 of the first appellate court in MCA 02/14 whereby the interim order granted by the trial court under Order 39 Rules 1 and 2 CPC was vacated. The counsel places on record copy of the judgment dated 06.12.2017 whereby the civil suit no. 99420/2016 in which the said order stood passed has itself been disposed of. In these circumstances, the petition has become infructuous and is disposed of accordingly.
