Parties to the suit have settled their disputes in terms of the written settlement agreement dated 29.1.2018 entered into before the Delhi High Court Mediation and Conciliation Centre. This settlement agreement satisfies the requirements of Order 23 Rule 3 CPC. Accordingly, the suit is disposed of and a decree is passed as per the terms contained in the settlement agreement dated 29.1.2018.

Since the suit is withdrawn prior to commencement of the evidence, in view of Section 16-A of the Court Fees Act, as applicable to Delhi, plaintiff will be entitled to refund of 50% of the court fees.
